TERMS OF USE & PRIVACY POLICY

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE ACCESSING OR USING THE VSERVE PLATFORM. IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT, YOU SHOULD/MAY NOT USE OR ACCESS THE VSERVE PLATFORM.

AGREEMENT/TERMS OF USE

Your use of the Service constitutes your acceptance of and agreement to all of the terms and conditions in these Terms of Use and the Privacy Policy and your representation that you are at least 18 years old. Your use of the Service will constitute your acceptance of and agreement to such changes. Therefore, it is recommended to go through these Terms of Use and the Privacy Policy frequently to see if they have been changed. Vserve can change/modify the agreement at any time.

Your access and use of the Vserve Platform acknowledges that you are bound to this Agreement. Vserve has a sole right to immediately terminate this Agreement or deny access to the Vserve Platform, at any time for any reason without notice. Vserve Platform or the Services may be out of date at any time, and we are under no obligation to update such material.

How Do We Work

Vserve is a platform which connects Madadgaars and customers with each other.

Madadgaars are those who use platform of Vserve to connect with customers and perform requested task(s) by customers.

Customers are those who use platform of Vserve to connect with Madadgaars for sake of availing Madadgaar’s Services.

Users is defined as Madadgaars and Customers both.

THERE IS NO EMPLOYMENT RELATIONSHIP BETWEEN VSERVE AND MADADGAARS.

WHO ARE WE

Vserve is a connecting platform for enabling connections between Users. Vserve does not take part in the interaction between Users. Vserve does not assure/guarantee for quality, timing, legality, or any other aspect whatsoever of any Services provided by Madadgaars, nor of the integrity, responsibility or any of the actions of any User. Vserve does not have control over the quality, timing or legality of Services delivered by its Madadgaar. Vserve has no responsibility about the suitability, reliability, timeliness, or accuracy of the Services requested and provided by users. Although Vserve does not perform background checks of users, Vserve cannot confirm that each User is who they claim to be. Vserve does not assume any responsibility for the accuracy or reliability of this information or any information on the Service.

VSERVE WILL NOT BE LIABLE FOR ANY CLAIM, INJURY OR DAMAGE ARISING IN CONNECTION WITH YOUR USE OF THE SERVICE.

Unless otherwise permitted by Vserve in writing, you may only possess one Account.

Vserve will not be responsible for any misconduct or unlawful act of Madadgaars.

COLLECTION OF PERSONAL INFORMATION

When you use our Services, we collect personal information (i.e. information that could be used to contact you directly such as full name, postal address, phone number, or email address) (“Personal Information”) and demographic information (i.e. information that you submit, or that we collect, that is not personal information; this may include, but is not limited to, post code, hometown, gender, username, device information, including the type of mobile device you use, a unique device identifier mobile network information, your mobile operating system, the type of mobile browser you use, device location, SMS data, age/birth date, browsing history information, searching history information, and registration history information)
We will collect your personal information, which may include:
• Name, gender, date of birth etc
• Contact information (mobile number, email I.d etc)
• Demographic information (complete address, current location etc)
• Mobile device information
• Access to other social networks.

Information We Collect From Other Sources

We may also receive information from other sources and combine that with Personal Data we receive from you or collect through our Services. For example:
If you choose to link, create, or log in to your Vserve account with a payment provider or social media service (e.g., Facebook), or if you engage with a separate app or website that uses our API (or whose API we use), we may receive information about you or your connections from that site or app.

Account, Password and Security

You are the sole authorized user of your account. You are responsible for maintaining the confidentiality of any password and account number provided by you or Vserve for accessing the Service. You are solely and fully responsible for all activities that occur under your password or account. Vserve has no control over the use of any User’s account and expressly disclaims any liability derived therefrom. Should you suspect that any unauthorized party may be using your password or account or you suspect any other breach of security, you will contact Vserve immediately.

GENERAL AGREEMENT

YOU AGREE NOT TO HOLD VSERVE, ITS AFFILIATES, ITS LICENSORS, OR ANY OF SUCH PARTIES’ AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, CORPORATE PARTNERS, OR PARTICIPANTS LIABLE FOR ANY DAMAGE, SUITS, CLAIMS, AND/OR CONTROVERSIES (COLLECTIVELY, “LIABILITIES”) THAT HAVE ARISEN OR MAY ARISE, WHETHER KNOWN OR UNKNOWN, RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING WITHOUT LIMITATION ANY LIABILITIES ARISING IN CONNECTION WITH THE CONDUCT, ACT OR OMISSION OF ANY USER (INCLUDING WITHOUT LIMITATION STALKING, HARASSMENTTHAT IS SEXUAL OR OTHERWISE, ACTS OF PHYSICAL VIOLENCE, AND DESTRUCTION OF PERSONAL PROPERTY), ANY DISPUTE WITH ANY USER, ANY INSTRUCTION, ADVICE, ACT, OR SERVICE PROVIDED BY VSERVE OR ITS AFFILIATES OR LICENSORS AND ANY DESTRUCTION OF YOUR INFORMATION. UNDER NO CIRCUMSTANCES WILL VSERVE ITS AFFILIATES, ITS LICENSORS, OR ANY OF SUCH PARTIES’ AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, CORPORATE PARTNERS, OR PARTICIPANTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL SPECIAL OR EXEMPLARY DAMAGES ARISING IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF THE SAME. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Termination, Suspension and User Blacklisting:

Without limitation, Vserve may terminate or suspend your right to use the Service if you breach any term of this Agreement or any policy of Vserve posted on the Service from time to time, or if Vserve otherwise finds that you have engaged in inappropriate and/or offensive behaviour. If Vserve terminates or suspends your right to use the Service for any of these reasons, you will not be entitled to any refund of unused balance in your account. In addition to terminating or suspending your account, Vserve reserves the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress

Taxation

Vserve is not an employment service and does not serve as an employer of any User. As such, Vserve will not be liable for any tax or withholding, including but not limited to unemployment insurance, employer’s liability, social security or payroll withholding tax.
It is acknowledged that if per annum income of Madadgaars reach the taxation slab as defined by the taxation authority, then Madadgaars will be responsible to pay the taxes by their selves. Vserve will not be liable to pay any sort of taxes of Madadgaars, as they are not employees of Vserve.

Indemnity

The Customer shall indemnify Vserve against all actions, suits, claims, demands, losses, charges, costs and expenses which Vserve may suffer or incur in connection with a claim by any third party resulting from a breach of the Customers obligations, undertakings, representations and warranties in connection with this Contract. Vserve reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to your indemnification. You will not, in any event, settle any claim or matter without the written consent of Vserve.

Force Majeure

The Vserve will use all reasonable endeavours to carry out the Works on the agreed dates but shall not be under any liability to the Customer if it should be either impossible or impracticable to carry out the Works on the agreed dates or at all, by reason of strike, lock out, industrial dispute, protests, storms, terrorism, act of god or any other event or occurrence beyond The Vserve’s control.

No Warranty/No Reliability:

It is acknowledged that Vserve is not giving any type of warranty and /or reliability of any type of service/job and equipment/ accessories (all things used during job either contained or provided by Madadgaar or purchased from any shop).

NO LIABILITY ON MADADGAARS:

1. Madadgaars will not be responsible for any loss or damage which if occurs from him prior, during or after the work/job.
2. In any case of purchasing of any equipment or accessory by Madadgaar, Madadgaar will not be responsible for the defect and correction of any defect of that particular equipment or accessory purchased by him during the job.
3. If Madadgaar fails to perform his job, then VSERVE will not be liable to make that job complete neither a new upcoming Madadgaar will be claimed upon that work. Customer has to re order by using the application and then job will be started once again considering a new job

Cleaning & Removal of Waste Materials.

The Customer will be responsible for the cleaning and removal from site of all waste materials resulting from the Works.

Access & Supervision at Property

The Customer shall provide clear access to his/her property to enable The Vserve to undertake the Works and will make all necessary arrangements with the proper persons or authorities.

INSTRUCTIONS, INFORMATION AND RULES FOR CUSTOMERS

• You can call a Madadgaar 7 days a week
• Timings will be 10:00 hours to 22:00 hours (10 AM to 10 PM)
• While registering yourself on the app, you must provide complete, proper, correct and truthful information
• When Madadgaar reaches at work place, before allowing him to enter at your work place, verify him by asking him that either he is electrician, plumber or carpenter, watch his picture on application and him physically
• You may also ask his Madadgaar ID and what tasks have you been assigned?
• After Madadgaar enters home, firstly brief all the tasks which are intended to be performed.
• Tell him about all tasks so that he can manage the work accordingly
• Madadgaar will only go once outside your home to purchase accessories
• If there is another person along with Madadgaar, don’t allow both of them to enter at work place, you may cancel the task and report us immediately
• If any mishap occurs, report us immediately.
• If there is someone else instead of him, do not allow that person to enter at your workplace and report the company immediately but not later than 12 hours
• You may also book us for the address other than your original address
• The task list will be shown in the application
• Any other work/task which is not included in the task list will not be done by Madadgaar
• You cannot force Madadgaar to perform any work that is not listed in task list
• You cannot harass or molest Madadgaar
• You must provide proper access to Madadgaar at all those locations at your workplace where work is to be done, so that he can perform job properly
• You must provide safe environment to Madadgaar
• Security of Madadgaar is upon you whenever he is in your working premises.
• You should buy accessories of your own, or you may request Madadgaar to purchase the accessories, but you must check receipt and market rate by yourself, company will not be liable for it
• You must arrange and provide some helping elements to Madadgaar for better and timely work which may include ladder, stool, rags etc…..
• You must be present at all times at the exact place where Madadgaar is working, in case of any mishap or theft, company is not liable
• If you feel some unlawful activity, you can report to police or legal actions against Madadgaar, if genuinely found for any misconduct of law
• You must supervise the work at all times
• You have to pay the exact amount of bill which is shown on receipt on your app
• If your total bill is expected to be more than 1000 PKR, you are expected to pay bills for multiple times
• Until you clear the bill, Madadgaar won’t be able to proceed work further
• If you fail to pay the bill, it will reflect a negative balance in your wallet, and you have to pay it now directly to company on easypaisa/Jazzcash account xxxxxxxx within 1 week
• If you do not pay the bill in the prescribed time, your ID may be temporarily or permanently blocked until you pay your dues
• When you pay the bill via Easypaisa/Jazzcash, you will have to share details of the payment transactions, after verification of transaction, it will be shown in your account within 48 hours, and then your account will be restored for further use if blocked.
• A single female at home is advised not to call Madadgaar when she is alone at home unless she is accompanied with another adult person
• You have to open the door as soon as possible but not later than 10 minutes, otherwise job will be automatically cancelled and you will have a penalty (most probably visiting charges)
• DON’T make Madadgaar to wait outside your home more, it may increase your bill
• As Madadgaar accepts your call, you will be provided with the details of upcoming Madadgaar
• You should call him on mobile at your earliest and guide him the way so that he can reach promptly and easily at your workplace.
• You must rate the Madadgaar as he feeds the bill in account
• You will have a complaint, feedback and suggestion option from where you can contact us
• The time to reach a Madadgaar at your workplace is 1 hour
• If you have not paid the amount for 2 times, ID may be temporarily or permanently blocked until you clear the dues (procedure told above)
• While work is in progress you can add more tasks of the same domain.
• Once work is finished, you have to re order/re book.
• Once task selected from your app after reaching of Madadgaar, you cannot remove it from your application, it will be removed from Madadgaar app if you don’t want that work or any selected work not to be performed.in this case, you have to request Madadgaar to remove that particular task.
• If you cancelled the task within 5 minutes after booking, there is no penalty on you, but if you cancel the task after 5 minutes, you will be fined a penalty.
